The General Conditions of Service are specified below, the acceptance of which by you is an indispensable condition for you to be able to validly use the Anna & Luigi Service.
GENERAL TERMS OF SERVICE
In order to allow your registration to the Anna & Luigi services and allow you to access them, we ask you to read and accept the General Service Conditions governing access to the services offered. The role of Anna & Luigi
Anna & Luigi is a Web App where Users make use of the meal booking and purchase service made available by Anna & Luigi itself, to receive food at home or collect it from Anna & Luigi.
A virtual place is therefore provided where the User has the opportunity and the tools to choose and book meals from menus updated and customized by Anna & Luigi. The data relating to the product will be visible to the User on the detail pages of each product. Anna & Luigi therefore takes care of all the activities and procedures relating to the administration and delivery of meals and foods in general to the User.
1. Registration and acceptance of the General Conditions of Service
To have access to the functions and services of the Web App, it is necessary to authenticate according to the methods indicated below, which is also essential for making a purchase or any activity offered by Anna & Luigi.
The authentication can be carried out with login through your corporate or personal account of Google, Microsoft or through other authentication services available from time to time.
The profile registered by you is personal and cannot be used by any other third party to access the Anna & Luigi services.
The User undertakes to keep his profile and not to allow third parties to use it. The User undertakes not to make more than one registration and not to register accounts with the aim of abusing the functionality of the application. Upon completing the registration, the User undertakes: not to provide false or misleading data, including false names, addresses and contacts, as well as undertakes not to fraudulently use credit or debit card numbers, not to try to circumvent the security measures of the Application or to violate the network, use the services of the Application for purposes unrelated to commercial transactions, undertake any illegal activity in connection with the use of the Web App and / or the services offered by the Anna & Luigi Service . The User is the one and only responsible for the conservation, confidentiality and use of his email and, consequently, with the registration itself, he exonerates the Web App from any liability deriving from improper use of the profile, by third parties who have become aware, in any way, of the access data referable to the User. The User, as soon as he becomes aware of it, undertakes to immediately communicate to Anna & Luigi, via e-mail at privacy @ Anna & Luigi.com, attaching a copy of a valid identity document - theft and / or loss of access data and / or unauthorized disclosure and / or unauthorized use of the account by third parties. Following the notification, Anna & Luigi will proceed to deactivate the registration and delete any content. The absence of reporting and subsequent disabling will determine the User's direct and exclusive responsibility for all uses and / or abuses of his profile _cc781905-5cde-3194 -bb3b-136bad5cf58d_ .
The User may request the cancellation of his registration and data at any time by sending a communication to Anna & Luigi at the following e-mail address: privacy @ Anna & Luigi.com. The agreement with Anna & Luigi will terminate immediately upon receipt of the request for termination of this agreement and the profile will be deleted.
It is understood that Anna & Luigi will in no case and for any reason be held liable towards the User or third parties for the modification, suspension, interruption and / or termination of the services. The Web App does not guarantee that the services offered therein, or the Web App itself, are free of viruses or other elements that may cause detrimental effects on any technology.
Following registration, the Web App is entitled to send the User e-mails with administrative and promotional content, information relating to account activity and purchases, updates on the Application and related services, other promotional offers, information. on purchases made by the User himself. The User may at any time opt out of receiving promotional e-mails by clicking on the link present at the bottom of the e-mails with promotional content .
2. Object of the Anna & Luigi services
The Anna & Luigi Service consists of:
⦁ booking and purchase services via an IT platform;
⦁ supply and administration of high quality foodstuffs;
⦁ home delivery of the aforementioned foodstuffs.
All prices include VAT. Any cost of delivery, unless otherwise specified, is included in the price of the products. All the products and prices indicated in the Application constitute an offer to the public with the limitations and methods contained in the Web App and in these General Conditions of Service. Given the nature of the products sold through the Anna & Luigi Service, the graphics of the delivered products may not coincide with that shown on the Application at the time of purchase.
The products may have a variable weight, whose actual weight compared to that indicated on the label can vary up to 20% more or less than what is indicatively proposed in the Web App. Anna & Luigi, therefore, cannot be considered in any way responsible for any changes in the Products published through the Anna & Luigi Service.
In no case Figo srl can be held responsible for the failure or incorrect fulfillment by the User of any legal or regulatory procedure in relation to the Agreement.
Users are aware that all costs relating to equipment and software programs necessary to activate and establish the connection to the application and all costs relating to connection to the network are their sole responsibility.
Portfolio: within your profile, once registered, there will be a Portfolio section. The latter displays any credit available to the user. When a new purchase is made, the system will give priority to any credit in the wallet over payment by ticket and / or credit / debit card. If the credit in the wallet does not cover the full amount for the purchase of the asset, the difference will be charged via the payment method selected by the user. The user can top up the wallet through various payment methods made available by the site or receive discount coupons on the wallet. The expiry of the credit will follow the following logic: all the credit loaded from 01/01 to 31/12 will expire on 30/06 of the following year.
3. Purchase by minors
The system does not allow to complete the online purchase operation if performed by users under the age of 18 as it is necessary to register by an adult e, in the case of online payment directly on the Web App, the credit card will necessarily be in the name of an adult.
4. Confirmation of purchase
If the payment is successful, the system displays the purchase receipt online which confirms the purchase made by the User.
In the event that the User requires an invoice, it will be necessary for the User to request it via email to info@annaeluigi.net. It will therefore be necessary to provide the Fiscal Code or the VAT number and SDI Code or PEC address so that Anna & Luigi can subsequently issue a valid invoice. Anna & Luigi, in some cases, may not even be subject to the obligation to issue the invoice (ex. Payment with Ticket Restaurant).
5. Methods of payment
The payment methods are:

Paypal, Nexi and major credit cards: payment data will be transferred, via a secure connection in SSL (Secure Socket Layer) encryption, compliant with PCI DSS (Payment Card Industry Data Security Standard), to Braintree Paypal Service for authorization and charge, and subject to the privacy policy for PayPal services. For security reasons, Anna & Luigi does not store or process any of these data directly .
It should be noted that for each transaction code the User has 4 payment attempts available. Once the 4 unsuccessful payment attempts have been made, it will no longer be possible to recover the transaction. Notwithstanding, payment by bank transfer or other methods such as cash payment may be required.
6. Methods of acceptance of orders, collection and delivery
The order sent by the User will be binding for Anna & Luigi only if the entire order procedure has been completed regularly and correctly without any error signaling from the Application. Anna & Luigi will not include in the order products not expressly reserved by the User.
The User cannot cancel the order or modify it; However, Anna & Luigi reserves the right to evaluate any changes and / or cancellation requests on a case-by-case basis.
Anna & Luigi will deliver the ordered products or by courier in the time slot of the agreed day.
For organizational and service efficiency reasons, the product cannot be verified or controlled by the User at the time of delivery. For any anomaly found, contact Anna & Luigi at the e-mail address support @ Anna & Luigi.com, which will act, where possible, promptly in order to verify and resolve any anomalies.
Anna & Luigi will not be responsible for any delays occurring during transport or delivery.
Likewise Anna & Luigi cannot be held responsible for any loss, damage, incorrect or non-delivery caused by events and / or causes of force majeure or unforeseeable circumstances, such as by way of example but not limited to: natural disasters, adverse weather conditions (such as heavy snow), any strikes (by one's own or other employees), accidents to means of transport, explosions, or any other similar or different cause.
Anna & Luigi will not be responsible in any way for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, Anna & Luigi undertakes not to charge the User the corresponding price.
For delivery, the presence of the User or his representative is required at the agreed address and time. If the User (or the person in charge) is not present, or is unable to pay, the order will be considered canceled and the User will be charged (as a penalty, even on subsequent expenditure) the cost of delivery and that of products that can no longer be sold to third parties; Anna & Luigi will also be entitled to exclude the User from the service or make the provision of the service subject to online payment.
7. Suspension of Anna & Luigi's Services
Anna & Luigi reserves the right to prevent a User from accessing the Anna & Luigi Service immediately and without notice in the event that it considers that there is a substantial violation of the provisions of these General Conditions of Service, in particular if it ascertains that: (a) the User's data are not updated; (b) in case of distorted use or for illegal purposes of the Anna & Luigi Service by the User.
Anna & Luigi undertakes to cooperate, collaborate and operate, in any way, with all competent authorities, including judicial authorities, where they order or request the Anna & Luigi Service to communicate their identity or location, as well as further data, of anyone who is responsible for any computer infringement (fraud, etc ...).
8. Complaints
For any observation or complaint relating to the Anna & Luigi Service, please send an email to the email address: support @ Anna & Luigi.com. All requests will be answered within approximately 48 (forty-eight) hours of receipt.
The comments of the users are always very useful, as an important moment of comparison that allows to offer a service more and more corresponding to the needs of the users.
9. Limitations of liability and rights of Figo srl
Figo srl assumes no responsibility for direct and indirect damages, of any nature, suffered in relation to the services provided by her, not directly and exclusively attributable to Anna & Luigi. Figo srl also reserves the right to withdraw, modify, suspend or interrupt any function or service related to the Anna & Luigi Service for its own technical or organizational reasons.
Figo srl reserves the right, whenever it deems it necessary, to amend and / or supplement these General Conditions of Service. The updated version of the same will in any case always be available on the Anna & Luigi Application.
The User acknowledges and accepts that Figo srl cannot in any case be held responsible for any type of damage, direct or indirect, deriving from the User or third parties: a) from the use or impossibility of using the services; b) any modification, suspension or interruption of services; c) from messages received or transactions carried out by Figo srl or through it; d) from unauthorized access or from alteration of transmissions and / or data of the User, including, among other things, any damage, even economic, by the same User that may be suffered due to lack of profit, use, loss of data or other intangible elements.
The User, without prejudice to any other provision referred to in this Agreement, expressly acknowledges and declares that: a) the use and use of the Anna & Luigi services is at their own and exclusive risk and is provided by Figo srl on the assumption of a exclusive and total assumption of responsibility for and borne by the User; b) Figo srl is exonerated from any type of liability and guarantee, express or implied, including the guarantee on the continuity, quality or quantity of the services, c) any material downloaded or otherwise obtained through the use of the services will be made at your choice and risk of the User and therefore all responsibility for any damage to computer systems or loss of data resulting from the uploading and / or downloading of material will fall on the User; d) Figo srl assumes no responsibility for any damage, loss of data, information, damage due to delay or loss of chance, inaccurate or failure to find information, restrictions or loss of access, difficulties or problems of any kind, errors, non-use authorized during access to the services or in relation to other forms of interaction within the services. Furthermore, the User is and will be solely and directly responsible for the maintenance and saving of data and information contained in the services.
Anna & Luigi will also not be responsible for the truthfulness and correctness of the information (allergies, dietary regimes, etc.) contained within the descriptive pages relating to foods and products that can be booked through the Web App .
Figo srl declines all responsibility for direct or indirect damages of any nature or in whatever form they occur, resulting from the use of the Web App and / or the news, photos and information contained therein.
10. Withdrawal
The User does not have the right to withdraw from the contract.
11. Limitation of the guarantees of Figo srl
Figo srl does not provide any type of guarantee as to the fact that the services correspond to its own requirements and / or to the User's expectations.
The User acknowledges that access to Anna & Luigi's services, the storage, publication and dissemination of the content sent is done at their own risk.
Furthermore, Figo srl does not provide any guarantee towards the User regarding the results that can be obtained with the use of the services, or regarding the truthfulness and / or reliability of any information, data or news obtained by the User for through the services.
12. Personal data and content of the Application
Figo srl will process all personal data provided by Users at the time of registration in full compliance with the provisions contained in Regulation (EU) 2016/679 (the "GDPR") and in Legislative Decree no. June 30, 2003, n. 196 (the "Code regarding the protection of personal data"), according to the methods and for the purposes indicated in the information provided to the User pursuant to art. 13 of the GDPR (the "Information").
By signing this contract, the User declares to have read and understood the Information, to which reference should be made here for all information relating to the processing of the User's personal data.
All rights reserved. In particular, all intellectual property rights (such as copyrights, patents, trademarks, service marks, commercial brands, designs, both registered and unregistered) present on the Anna & Luigi Web App, as well as all published information content. or access to which is allowed through the services provided by the Anna & Luigi Service itself, all the databases managed by Anna & Luigi, the texts, graphics, software, photos, videos, music, sounds, underlying source codes and all software, and in general all information offered and contained in the Application, are owned by Anna & Luigi.
All the material listed above may not be reproduced, redistributed or copied, distributed, republished, downloaded, displayed, published or transmitted in any form or by any means, sold, rented, sub-licensed, used to create derivative works, or exploited in any without the prior and express authorization of Anna & Luigi. It is permitted to find and view the content of the Application on the screen of a PC, tablet or smartphone, to store the content in electronic form on a disk (however not on a server or on a storage device connected to a network) or to print a copy. of such content exclusively for personal and non-commercial use, provided that it keeps intact all notes relating to copyright and other proprietary rights.
It is forbidden to reproduce, modify, copy, distribute or use the materials or contents of the Application for commercial purposes without the prior and express authorization of Anna & Luigi.
All rights, including goodwill and, where present, trademarks, on the names of the Anna & Luigi Application, are owned by the Anna & Luigi Service. The other names of goods and products, as well as the company names mentioned on the Application, even if they represent trademarks, registered or unregistered, are the exclusive property of their respective owners.
The Anna & Luigi Application reserves the right to check the comments left by users following the purchase of goods and products, avoiding the publication of comments that are not appropriate to the nature of the Service offered by the Anna & Luigi Service.
13. Applicable law and competent court
The law applicable to these General Conditions of Service is the Italian one.
SPECIAL CLAUSES
Pursuant to and for the purposes of art. 1341 and 1342 of the Italian Civil Code, the following clauses are expressly accepted: 2 (Object of Anna & Luigi's Services); 4 (Purchase Confirmation); 8 (Access to Anna & Luigi's Services); 9 (Limitations of liability and rights of Figo srl).
DEFINITIONS
For the purposes of the interpretation and execution of the aforementioned General Conditions of Service, the following definitions apply, in addition to those possibly contained in the legal texts:
Web App: set of web pages, accessible at the URL: https://www.annaeluigi.net/ and in the future through other platforms, through which Anna & Luigi offers its services.
Anna & Luigi: the person providing the Services, owner of the Application and of the domains from which it is accessible.
